PASSENGER WAIVER & RELEASE OF LIABILITY

CR West LLC – Utah

IMPORTANT – PLEASE READ CAREFULLY

This is a legally binding agreement that affects your legal rights.

1. Parties & Services

This Waiver & Release (“Agreement”) is entered into between CR West LLC, a Utah limited liability company (“Company”), and the undersigned individual (“Passenger”), in connection with commercial passenger transportation services.

2. Assumption of Risk

Passenger understands and voluntarily assumes all ordinary risks inherent in passenger transportation, including but not limited to vehicle operation, traffic conditions, weather, road conditions, mechanical issues, actions of third parties, delays, and route changes beyond the Company’s control.

3. Release of Liability

To the fullest extent permitted under Utah law, Passenger releases and waives all claims against CR West LLC and its owners, members, managers, employees, drivers, contractors, and agents arising out of or related to the transportation services provided, except for claims resulting from gross negligence or willful misconduct, which are not waived.

4. Scope of Waiver / Other Passengers

This waiver applies only to the individual signing below. Each adult passenger is responsible for their own voluntary decision to participate and assumes their own ordinary risks associated with passenger transportation.

5. Delays & Operational Decisions

Passenger acknowledges that pickup and arrival times are estimates only and are not guaranteed. The Company may delay, reroute, modify, or terminate service when deemed necessary for safety or operational reasons, and shall not be liable for missed flights, connections, or events.

6. Passenger Conduct

Passenger agrees to behave in a safe and lawful manner. Unsafe, disruptive, or illegal behavior may result in immediate termination of service without refund.

7. Medical Emergencies

In the event of a medical emergency, Passenger authorizes the Company to seek emergency medical assistance and agrees to be responsible for all related medical costs.

8. Insurance Disclaimer

The Company does not provide personal medical, travel, or property insurance for Passengers. Passenger is responsible for maintaining their own coverage.

9. Minors

If Passenger is under eighteen (18), a parent or legal guardian must execute this Agreement on the minor’s behalf and represents that they have authority to do so.

10. Governing Law & Severability

This Agreement shall be governed by the laws of the State of Utah. If any provision is held unenforceable, the remaining provisions shall remain in effect.

11. Acknowledgment & Voluntary Consent

By electronically signing an applicable agreement with CR West LLC, Passenger acknowledges that they have read and understand this Agreement and voluntarily agree to be bound by its terms.
