Passenger Pickup Timing, Wait Time & Collections Policy
This Passenger Pickup Timing, Wait Time & Collections Policy (“Policy”) is entered into between CR WEST Transportation Services (“Company”) and the undersigned client (“Client”) and governs all transportation services provided by the Company. This Policy is governed by and interpreted in accordance with the laws of the State of Utah.
Passenger Responsibility
The Client is responsible for ensuring that all passengers in the Client’s party are present, prepared, and ready for transport at the designated pickup time and location. Any delay caused by the Client or any passenger—including, but not limited to, late arrival, failure to be ready at pickup time, inaccurate or incomplete scheduling information, extended stops, location changes, or requests for unscheduled stops—shall be the sole responsibility of the Client.
Courtesy Grace Period
A courtesy grace period of fifteen (15) minutes from the scheduled pickup time is provided. Waiting time beyond this grace period is billable as outlined below.
Waiting Time Charges
Waiting time beyond the grace period will be charged at a rate of Twenty-Five Dollars ($25.00) per thirty (30) minutes, or any portion thereof. Waiting time is calculated from the scheduled pickup time and may be rounded up to the next thirty-minute billing increment, as permitted by Utah law.
All waiting time charges are due immediately and are authorized to be charged to the payment method on file.
Schedule Impact and Overtime
Passenger-caused delays that interfere with subsequent scheduled services may result in the Company ending service at the originally scheduled end time or, if availability permits, continuing service at the waiting/overtime rate of Twenty-Five Dollars ($25.00) per thirty (30) minutes. Continued service is not guaranteed and is subject to driver and vehicle availability.
Extended Delays / Right to Cancel
If the Client or any passenger is more than one and one-half (1.5) hours later than the scheduled pickup time, the Company reserves the right, at its sole discretion, to cancel the service, release the assigned vehicle and driver, and retain all amounts paid, with no refund.
Missed Pickups / No-Shows
Failure of the Client or passengers to arrive within a reasonable time following the grace period, or meeting the extended delay threshold described above, may be classified as a no-show. No-shows may be charged up to one hundred percent (100%) of the total service fee, as permitted by Utah law.
Exceptions
No additional charges will be assessed for delays caused solely by the Company, including driver lateness or mechanical failure. Delays caused by events beyond the Company’s reasonable control—including weather conditions, traffic congestion, road closures, accidents, or law enforcement activity—do not constitute grounds for refunds.
Authorization for Charges (Card-on-File Alignment)
By booking services, signing electronically, or utilizing the Company’s services, the Client expressly authorizes CR WEST Transportation Services to charge the payment method on file for all applicable waiting time, overtime, cancellation, no-show, damage, cleaning, and collection-related charges incurred under this Policy.
The Client acknowledges that such charges are fair, reasonable, and agreed upon, represent liquidated damages rather than penalties, and agrees not to dispute or initiate chargebacks for charges assessed in accordance with this Policy.
Collections & Payment Enforcement Addendum
This section constitutes the Collections & Payment Enforcement Addendum and is incorporated into this Policy by reference.
In the event that any balance remains unpaid, the Client agrees that the Company may, at its discretion, refer the outstanding balance to a third-party collection agency or legal counsel. The Client agrees to be fully responsible for all reasonable costs associated with collection, including but not limited to collection agency fees, court costs, interest as permitted under Utah law, and reasonable attorney’s fees.
The Client expressly waives any requirement for advance notice prior to referral of an unpaid balance to collections and acknowledges that such action does not constitute a breach of this Agreement by the Company.
Governing Law and Venue
This Policy shall be governed by and interpreted in accordance with the laws of the State of Utah. Venue for any dispute arising under this Policy shall lie exclusively in the state or federal courts located within the State of Utah.
Electronic Acknowledgment & Acceptance
By booking services with CR WEST Transportation Services, signing an electronic agreement via DocuSign, or otherwise utilizing the Company’s services, the Client acknowledges that they have reviewed, understand, and agree to be bound by this Passenger Pickup Timing, Wait Time & Collections Policy.

Electronic acceptance, including DocuSign execution or continued use of services, constitutes a legally binding agreement under Utah law.
